Many foreigners are drawn to the area not just for its beauty, but also for its real estate market. If you are a foreigner looking to purchase property in the Riviera Maya, it is important to understand the purchasing process and the legal requirements.

The first step in purchasing property in the Riviera Maya is to find a reputable real estate agent. An experienced agent can guide you through the process and help you find the property that meets your needs and budget. It is important to work with an agent who is knowledgeable about the local market and has experience working with foreign buyers.

 

Once you have found a property that you are interested in, you will need to make an offer. The offer should include the purchase price, any contingencies, and the closing date. It is important to note that in Mexico, it is common for negotiations to take place between the buyer and seller before a final agreement is reached.

If your offer is accepted, you will need to sign a purchase agreement and provide a deposit, typically around 30% of the purchase price. This deposit is held in an escrow account until the closing date when it will be applied towards the purchase price.  It is also recommended to hire a real estate attorney who can review the purchase agreement and ensure that all legal requirements are met.

At the closing, the remaining balance of the purchase price will be paid, and the property title will be transferred to your name. It is important to note that in Mexico, the title transfer process can take up to two months to complete, so patience is key.

As a foreigner purchasing property in Mexico, there are certain legal requirements that must be met. Foreigners are required to obtain a permit from the Mexican government in order to own property within 50 kilometers of the coastline or within 100 kilometers of the international border. This permit is called a “fideicomiso”, which is essentially a trust agreement that allows foreigners to own property in Mexico through a Mexican bank.
